Supplemental Terms and Conditions of Use

These Supplemental Terms and Conditions of Use for Job Hunter supplement the Terms and Conditions of Use that are generally applicable to Chaminade’s website (the “Terms and Conditions of Use”).  Please read the following Supplemental Terms and Conditions of Use carefully before using Job Hunter.  Your use of Job Hunter is expressly conditioned on your acceptance of these Supplemental Terms and Conditions of Use without any modifications.  Your use of Job Hunter constitutes your acceptance of all the terms and conditions set forth herein, as well as the Terms and Conditions of Use.  If you do not agree with any part of the Supplemental Terms and Conditions of Use or the Terms and Conditions of Use, you may not use Job Hunter. 

I.          Definitions

The definitions set forth in the Terms and Conditions of Use are hereby incorporated into these Supplemental Terms and Conditions of Use. 

The term “Job Hunter” refers to the Job Hunter service available through Chaminade’s website as well as all portions of Chaminade’s website related to the Job Hunter service. 

II.        No Unlawful or Prohibited Use

Job Hunter is an employment board that allows employers to view applicants’ resumes and applicants to view employers’ job postings.  Job Hunter is intended to be used solely for the following two purposes: (1) by individuals to obtain employment and career information; and (2) by employers to find employees.  As a condition of your use of Job Hunter, you agree that you will not use Job Hunter for any purpose that is unlawful or prohibited by these Supplemental Terms and Conditions of Use, including but not limited to the following:

  1. Posting any incomplete, false, or inaccurate biographical information;

  2. Posting information about or on behalf of someone other than you, unless you have express permission to do so;

  3. Impersonating another person;

  4. Posting any franchise, pyramid scheme, “club membership”, distributorship or sales rep agency arrangement, or other business opportunities that require an up-front or periodic payment, pay commissions only (except for postings that make clear that the available job pays commissions only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), or require recruitment of other members, sub-distributors, or sub-agents;

  5. Posting material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it;

  6. Posting material that reveals trade secrets, unless you own the trade secrets or have the permission of the owner;

  7. Taking any action in connection with Job Hunter that that infringes on the intellectual property rights, privacy rights, or publicity rights of others;

  8. Engaging in any conduct that violates the acceptable use policies set forth in the Chaminade University Policy Manual, Volume II, Section 2.9;

  9. Deleting or revising any material posted by any other person or entity;

  10. Sending and/or receiving content and/or materials that are not directly related to the purpose of Job Hunter;

  11. Posting material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity;

  12. Posting a sexually-explicit image or statement;

  13. Posting material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information; or

  14. Taking any action that may create liability for Chaminade or may cause Chaminade to lose (in whole or in part) the services of its ISPs or other suppliers.

III.       User Information and Privacy Issues

You will need to register and create an account before you can use Job Hunter.  When you register with Job Hunter as an applicant, you will be able to post your resume, allow employers to view your information, and apply for jobs.  If you register as an employer, you will be able to post jobs and search resumes.

As part of the registration process, you will be asked to provide Chaminade with certain information about yourself, including but not limited to a valid email address (the “Personal Information”).  You agree to: (1) provide true, accurate, current, and complete Personal Information as prompted by the registration form; and (2) promptly update your Personal Information to keep it true, accurate, current, and complete.  If you provide any Personal Information that is untrue, inaccurate, not current, or incomplete, or Chaminade has reasonable grounds to suspect that such Personal Information is untrue, inaccurate, not current, or incomplete, Chaminade has the right to suspend or terminate your account and bar you from any and all current or future use of Job Hunter (or any portion thereof).

Use of your Personal Information will be governed by Chaminade’s Privacy Policy.  You agree to abide by the Privacy Policy.  In addition to the terms and conditions of the Privacy Policy, you understand and agree that Chaminade may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application.  You also understand and agree that Job Hunter may include certain communications from Chaminade, such as event announcements and administrative messages, and that these communications are considered part of Job Hunter’s membership and you will not be able to opt out of receiving them.

IV.       Registration and Password

You are responsible for maintaining the confidentiality of your registration information and password.  You shall be responsible for all uses of your registration and password, whether or not authorized by you.  You agree to immediately notify Chaminade of any unauthorized use of your registration or password.  You must renew your registration annually in order to continue receiving the benefit of being “live” on Job Hunter.

V.        Access Fees and Required Equipment

You are responsible for obtaining access to Job Hunter.  This access may involve third party fees, such as Internet service provider or airtime charges.  You are responsible for any such fees.  In addition, you must provide, and are responsible for, all equipment necessary to access Job Hunter.

VI.       Nature of Chaminade’s Involvement; Risks and Disclaimers

Chaminade acts as a passive conduit for the online distribution and publication of user-submitted information through Job Hunter.  Chaminade has no obligation to, and does not, screen, review, monitor, or censor listings or other information or materials posted or communicated through Job Hunter (the “Job Hunter Postings”).  As a result, and for other reasons as well, there are certain risks associated with using Job Hunter, including but not limited to the following:

  1. Chaminade has no control over, and makes no representations or warranties regarding: (1) the quality, safety, or legality of the jobs listed on Job Hunter or the Job Hunter Postings; (2) the truthfulness, accuracy, reliability, completeness, or timeliness of the Job Hunter Postings; (3) the ability of employers to offer job opportunities to applicants; (4) the ability of applicants to fill job openings; or (5) the character, nature, integrity, or business practices of employers or applicants.

  2. There is the risk of physical harm, dealing with strangers, dealing with people who might not legally be able to work (e.g., certain foreign nationals and underage persons), or people acting under false pretenses.

  3. Because user authentication on the Internet is difficult, Chaminade cannot and does not confirm that each user is who he or she claims to be.

  4. Chaminade is not involved in user-to-user dealings and does not control the behavior of Job Hunter participants.

  5. Job Hunter is provided “AS IS”, and Chaminade assumes no responsibility for the timeliness, deletion, misdelivery, or failure to store any user communications or personalization settings.

  6. Please see Section X of the Terms and Conditions of Use for additional disclaimers of warranties and limitations on Chaminade’s liability.

You acknowledge that any use of Job Hunter and/or reliance on Job Hunter Postings will be at your own risk.  Moreover, you are solely responsible for the form, content, accuracy, and consequences of your Job Hunter Postings.  
Chaminade shall not be considered an employer with respect to your use of Job Hunter.  Chaminade shall not be responsible for any employment decisions made by any entity or person using Job Hunter. 

VII.     Links to Third Party Websites

Job Hunter may contain hypertext links to other websites that are maintained by and under the control of third parties.  Please see Section VIII of the Terms and Conditions of Use for terms and conditions applicable to such links. 

VIII.    Discontinuance of Job Hunter

Chaminade reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, Job Hunter (or any part thereof) with or without notice.  This includes changes to employers posting jobs as well as searching candidates.  You agree that Chaminade shall not be liable to you or to any third party for any modification, suspension, or discontinuance of Job Hunter. 

IX.       Violation of These Supplemental Terms and Conditions of Use

If Chaminade determines that you have violated any provision of these Supplemental Terms and Conditions of Use, Chaminade has the right, in its sole discretion, to do the following: (1) pursue any and all of its legal remedies against you; (2) remove any Job Hunter Postings that violate these Supplemental Terms and Conditions of Use; (3) cancel your Job Hunter registration; (4) block you from using Job Hunter and any other portion of the Chaminade website; (5) terminate any other services provided to you by Chaminade; and (6) take any action with respect to user-submitted information that Chaminade deems necessary or appropriate in its sole and absolute discretion if it believes such user-submitted information may create liability for Chaminade or may cause Chaminade to lose (in whole or in part) the services of its ISPs or other suppliers.  Chaminade shall have no liability or responsibility to users of Job Hunter for Chaminade’s decision about which, if any, of the above rights to exercise. 

X.        Indemnification

You agree to defend, indemnify, and hold harmless Chaminade, and its officers, directors, employees, and agents from and against any and all claims arising from or related to your use of Job Hunter or your violation of these Supplemental Terms and Conditions. 

XI.       Release

You hereby fully and forever release Chaminade from any and all claims arising out of your use of Job Hunter. 

XII.     Amendments to These Supplemental Terms and Conditions of Use

From time to time, it may be necessary for Chaminade to amend these Supplemental Terms and Conditions of Use.  You are responsible for regularly reviewing these Supplemental Terms and Conditions of Use so that you will be aware of any changes.  Please note that your continued use of Job Hunter means that you accept the amendments to these Supplemental Terms and Conditions of Use. 

XIII.    Governing Law

See Section XII of the Terms and Conditions of Use. 

XIV.    Restriction on Use Based on Location

Use of Job Hunter is unauthorized in any jurisdiction that does not give full effect to all provisions of these Supplemental Terms and Conditions of Use. 

XV.      Accessing Job Hunter in Countries Other Than the United States

Chaminade makes no claims regarding the legality of viewing or using Job Hunter in any country other than the United States.  Anyone who views or uses Job Hunter in a country other than the United States does so at his or her own risk. 

XVI.    Severability

If any provision of these Supplemental Terms and Conditions of Use is held to be invalid or unenforceable, the validity and enforceability of the other provisions of these Supplemental Terms and Conditions of Use will remain unaffected. 

XVII.   Headings

The headings in these Supplemental Terms and Conditions of Use are included solely for convenience and will not limit or otherwise affect these Supplemental Terms and Conditions of Use. 

XVIII. Entire Agreement

These Supplemental Terms and Conditions of Use and any other documents, policies, and/or guidelines referred to herein constitute the entire agreement between you and Chaminade regarding this website, and supersede all other prior or concurrent oral or written letters, agreements, or understandings related to Job Hunter.
